We appeal to facts and reasons as we here lay our defense in relation to the concern of our fraternal brothers and sisters in Upsilon Chapter. hope we can march hand in hand, side by side and in harmony towards the greatness of our beloved ALPHA PHI OMEGA. We established our chapter for sole purpose of carrying the objectives, missions and principles our institution APO nothing less. We respect UPSILON Chapter, after all we are in the same organization, with the same ideals, principles and objectives, i.e.: LEADERSHIP, FRIENDSHIP and SERVICE. Subject: Answer to the opposition made by Upsilon Chapter in letter dated 16th May 2003

Brothers and Sisters:

Fraternal Greetings!

This is with regard to the letter made by our fellow brothers in UPSILON Chapter of Philippine College of Criminology (hereafter called PCCR) dated 16th May 2003 and was received on 22nd May 2003 by the NATIONAL COUNCIL which substantially provides for the opposition of the existence of MANILA LAW COLLEGE (hereafter called MLC) as petitioning chapter.

For information, we were surprised upon learning the opposition considering that there was no manifestation as to such opposition was made by their Alumni President during the period in which we were starting to gather our membership (2001-2002). It was only this opening of school year 2003-2004 when we saw the copy of the above letter in our chapter’s bulletin board posted unauthorized.

After our chapter’s deliberation as to the matter, we unanimously decided to depend our side and lay our bases to render our capacity as a legitimate chapter. Legitimate in the sense that we are qualified to make representation to be bona fide chapter member of this prestigious institution.

Please note that we, as member of this distinguished organization definitely respect the territory of Upsilon chapter being the legitimate chapter in PCCR and we have no intention of evading it.

Hence:

1. We admit the allegations stated in numbers three(3) and four(4) of Upsilon’s chapter petition; and
2. We specifically deny the allegations stated in numbers one (1) and five (5) of their petition. Hereafter our established ground:

a. That, Upsilon chapter erred in concluding that PCCR AND MLC are of the same institution. Please be informed that MLC is in fact a distinct and separate institution founded and established since 1899 which formerly known as the ESCUELLA DE DERECHO DE MANILA and was then renamed only on 1924 as MANILA LAW COLLEGE. She was a registered institution with the SECURITY AND EXCHANGE COMMISSION (hereafter called SEC) and other government agency concerned. AND, further recognized by the SUPREME COURT as a legitimate LAW SCHOLL.

The premise of UPSILON Chapter that “same ownership” entails same category as one institution is highly debatable and accepts correction. Please note that “SAME OWNERSHIP” status does not necessarily follows that they are the same institution, considering that MANILA LAW COLLEGE and PCCR has its own charter and by laws, mission and objective. As evidence by their respective registration with the SEC (MLC with SEC#0000085957 and PCCR SEC#000008758). Hence, such premise is very much erroneous. Further MLC bears her owned seal and logo which clear manifestation of being as such.

The premise of “THE SAME POSTAL ADDRESS” to consider the two institutions the same is unmeritorious. Please note that MLC postal address is different from PCCR as per their registered addresses with the SEC. MLC is No. 641 Sales Street Sta. Cruz Manila, whereas PCCR is No. 634 Sales Street Sta. Cruz Manila. Therefore, on that given merit, the two institutions cannot be considered in any manner as one.

b. The allegation of our fellow-brothers at UPSILON Chapter “that there was no such advised received verbal or written regarding the establishment of the MANILA LAW COLLEGE Chapter to co-exist of that Upsilon Chapter from the MANILA LAW COLLEGE Chapter founder” IS VOID OF MERIT. Because, during the period of our foundation or the time in which we were starting to gather our prospective member our founders have been in contact with their ALUMNI and yet there was no manifestation as to their opposition. (PLEASE NOTE THAT UPSILON HAS NO RESIDENT MEMBERS DURING SAID PERIOD HENCE OUR SOCIALIZING INVOLVES ONLY THEIR ALUMNI).

As we borrowed the phrase used by our fellow-brothers at UPSILON Chapter for which we affirmed, “That, MANILA LAW COLLEGE has no separate building due to low enrollee of students and only vacant rooms of the Philippine College of Criminology High School department”. With this we can assess that even them have on their mind that MANILA LAW COLLEGE is a separate institution. Only low number of enrollees precluded it. Please be informed that the MLC administration do not confine only with the present status as regards to the place in which they were situated but planned to have their separate building on its own once they meet the required budget.

Furthermore in history alone, we can say that MLC is very much different from PCCR.

With the foregoing we therefore respectfully prayed:

1. To set aside the petition made by our fraternal brothers in Upsilon Chapter;

2. To recognize the separate and distinct personality of the two institution (PCCR and MLC) since they are in fact have their own personality different from each other as evident by their registration with the SEC; and

3. To allow us proceed with our objective of furthering the principle and mission of this prestigious institution having on our shoulder the name and personality of our ALMA MATER, the MANILA LAW COLLEGE.

We these notes, we now submit and we hope and trust the above-mentioned merits are considered. Further, we definitely respect the control of UPSILON over their studentry and we have no intention of recruiting criminology students or any students of the PCCR in particular. Our membership is exclusively and primarily for the law students of MANILA LAW COLLEGE only.

Attached herewith is a copy CERTIFICATE OF CORPORATE FILING/INFORMATION issued by SEC dated 31st of July 2003 and copy of historical documents of MLC to support our contention.
